Unfair Dismissal

In order to bring an unfair dismissal claim in the Employment Tribunal, you normally need to have two years’ continuous employment. In other words, if you have not been in your current employment for at least two years, you will not be able to claim unfair dismissal unless you think the reason for the dismissal was for ‘whistleblowing’ or if you have suffered some kind of discrimination.

It is important to remember that you must normally lodge a claim in the Tribunal within three months of your dismissal. However, you will first be expected to contact ACAS for Early Conciliation, in which case the limitation period is extended.
